(Nov. 16th)  The following is the West-Win Homeowners' Association summary of the 11/6/2008 Zoning Board of Appeals Recommendation Meeting and the official ZBA transcript.

DUPAGE COUNTY ZONING BOARD OF APPEALS NOVEMBER 6, 2008 RECOMMENDATION MEETING SUMMARY

The public hearing regarding the REZ church was closed on September 25, 2008. The chair of the Zoning Board of Appeals gave a cutoff date of October 31, 2008 to submit any additional documentation on the issue.  The West-Win Homeowners’ Association and other concerned parties submitted numerous exhibits to support the fact that the Petitioner has not overcome the burden of proof that would allow the granting of a special use. Nevertheless, at the ZBA recommendation meeting on November 6, 2008, the ZBA in their efforts to move this issue along to the next stage, granted approval with the following conditions; (1) there would be no bells allowed, (2) there would be no carillon allowed, (3) there would be no outside amplification of any kind.  In addition the County Traffic Department has indicated that numerous offsite improvements will be necessary.  Therefore, the approval given was also with the stipulation that additional information must be obtained in regard to traffic. Follow up calls to the ZBA by West-Win members on November 7 and 10, indicate that the church will need to undertake additional studies at their expense to obtain the information needed for the County.  It appears that the County has a great deal of faith in the report submitted by Metro Transportation, the traffic consultant hired by West-Win.  We also understand, from County personnel, that this issue in on the calendar for the November 18, 2008 Development Committee and that there is a possible date of November 25, 2008 or December 9, 2008 for the matter to be heard and either approved or disapproved by the DuPage County Board.

Many projects are approved by the ZBA that never make it to full completion, due to County Department requirements that are handed down after a complete review is undertaken.  So this issue is just beginning its path through the County stages and might eventually be settled in the Courts.
